Tesla destination charging and electric vehicle charging services are now available at Fashion Walk Carpark.

Terms and Conditions for Use of Car Park

1. In these Terms and Conditions,

• “Car Park” means this car park managed and/or operated by the Company.
• “Company” means Hang Lung Real Estate Agency Limited and/or its authorized agents.
• “Parking Space” means a place delineated in a rectangular shape by the Company where a vehicle may stay or be parked.
• “Parking Label” means a label issued by the Company to a registered vehicle.
• “Pass Card” means a card issued by the Company to a holder of quarterly ticket/monthly ticket for the purpose of entering and leaving the Car Park.
• “Terms and Conditions” means these Terms and Conditions for the use of Car Park.
• “Users” means any person who uses the Car Park, including the owner of his/her duly authorized agent, or the driver of the vehicle.

2. In these Terms and Conditions, unless otherwise stated, a reference to the singular includes the plural and vice versa and a gender includes all genders.
3. All Parking Label holders should display valid Parking Labels on wind screens of their vehicles.
4. The User Shall obey and comply with all the applicable laws, ordinances, rules and regulations as well as directions given by the Company, whether they are given verbally or in writing.
5. The User shall park his/her vehicle within the designated Parking Space and shall not allow his/her vehicle to obstruct or interfere with other persons or vehicles using the Car Park, the use of any exit, entrance and driveway in the Car Park.
6. No driving training, test driving, car repairing, loading/unloading or speeding (beyond 8km/h) is permitted in the Car Park.
7. No car washing is permitted in the Car Park unless authorized by the Company.
8. The User shall give his/her name and address and produce his/her valid driving licence upon demand by the Company.
9. If a change occurs in the registration number of vehicle previously provided by the Pass Card holder to the Company, the Pass Card holder shall inform the Company of the change in writing within 24 hours of the change.
10. No vehicle carrying inflammable or dangerous goods is permitted to enter the Car Park.
11. In the event of mechanical failure of the vehicle, the User shall immediately report to the Company and contact the garage to tow the vehicle.
12. Any vehicle parked in the Car Park after expiry date of the Pass Card shall be charged on an hourly basis. The Company reserves the right to detain, move or tow away any vehicle parked in the Car Park exceeding five (5) days without valid Pass Card. In such circumstances the User shall be liable to pay any and all charges incurred thereof including without limitation hourly parking fee, administration fee and towing fee.
13. All Users shall obtain an hourly parking ticket upon entry of the Car Park except for those with valid Pass Cards.
14. No Vehicle shall be parked in the same Parking Space for more than three (3) days without permission.
15. The User shall comply with the directions and instructions of the Company if any appliance or equipment in the Car Park is out-of-order for whatever reasons.
16. The Company reserves the right to refuse entry of any vehicle or person to the Car Park and to detain any vehicle until a valid Parking Label for the vehicle is produced or other evidence is given to the Company’s satisfaction.
17. The Company reserves the right to detain, move or tow away any vehicle left in the Car Park in an unauthorized space or otherwise obstructing other Users in the Car Park. Any vehicle may be moved or driven by the Company to such place as the Company deems fit during the period of detention. Such vehicles shall only be released upon payment of a release fee prescribed by the Company.
18. The Company reserves the right to detain, move or tow away any abandoned vehicle and dispose of the same, and recover the costs of disposal from the User. A vehicle will be deemed to be abandoned if it is parked in the Car Park without valid hourly parking ticket or Pass Card or Parking Label; or it does not have a valid vehicle licence.
19. The User shall be fully liable for any damage to the Car Park, including without limitation the structure of and/or fixtures and/or equipment therein, caused by the User or his vehicle.
20. The Company shall not be liable for any loss or theft of, or damage to any vehicle or any of its contents or accessories whilst such vehicle is parked or situated in the Car Park or otherwise in the Company’s custody or control.
21. The Company shall not be liable for any injury to or death of any person whether the same is caused by the negligence, default, act or omission of the Company, its employees or agents, or by any equipment or appliances used by the Company in the provision of the Car Park, or by the condition of structures, fixtures or fittings attached to the Car Park, or by any other third party. The User shall be solely liable for all such liabilities and shall indemnify the Company in respect of any such claims or legal proceedings arising.
22. The User shall indemnify the Company in respect of any claims made against the Company arising out of the use of the Car Park, any act or omission by the User, his agents or passengers.
23. In the event the User is in breach of these Terms and Conditions, the Company has the right to apply a wheel clamp to the vehicle and/or remove the vehicle by having it towed away without prior notice. The Vehicle will be released only upon payment of an administration fee. The Company shall not be liable for any damage thereby incurred.
24. No person has authority to amend, vary, cancel or waive these Terms and Conditions unless such amendment, variation, cancellation or waiver is authorized in writing by the C
25. The in-out records (if any) of the vehicles are the private property of the Company. The Company may in its absolute discretion decide whether or not to disclose or release such records and if so, on what terms and conditions.
26. These Terms and Conditions are subject to change without prior notice and the Company has the final decision for any disputes arising therefrom.
27. If any of these Terms and Conditions shall be held to be invalid, illegal or unenforceable, all of the remaining terms and conditions hereof shall remain in full force and effect.
28. These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong and any claims arising under these Terms and Conditions are subject to the exclusive jurisdiction of Hong Kong courts.
29. In case there is any inconsistency or ambiguity between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.
